Building permits and paperwork in Torrevieja

Before talking price, the first question any well-planned job answers is which permit it needs: not every renovation needs the same paperwork, and getting the permit wrong costs time and money. This guide explains, in plain terms, the two permit types that exist in the Valencian Community and which one applies to each kind of job.

The two permit types that exist

In the Valencian Community, every job falls under one of two permit types. The declaración responsable is a notification to the town hall in which the owner declares the works comply with regulations; there's no need to wait for approval before starting. It applies to renovations that don't touch structure or add built volume or floor area: a kitchen, a bathroom, changing flooring, painting a façade, waterproofing a solarium. The licencia urbanística (full building licence), on the other hand, requires a technical project signed by an architect and explicit council approval before starting. It's the one that applies when the works increase built volume or floor area: enclosing a porch into the home, an extension, building from the foundations up, or any work affecting a building's façade.

Where it's filed and how long it takes

Where you file depends on the municipality: for the Orihuela Costa urbanisations, at Orihuela's municipal office on the N-332 in Playa Flamenca — no 35 km trip to Orihuela town; for Torrevieja and its urbanisations, at the town hall itself. The processing time for a full building licence varies by municipality and by each technical office's workload; that's why we file the paperwork with enough margin so the permit never threatens the start date agreed in the work schedule. Special cases we see often on the coast

Buying a home with old unpermitted extensions. Very common in local property purchases: a previous owner enclosed a porch or extended without filing anything. In the municipality of Orihuela it's regularised through the Declaración Responsable de Segunda Ocupación (Second Occupation declaration); it's worth resolving before renovating on top of anything unregularised. A building's ITE inspection. Past a certain age, the ITE (statutory building inspection) is compulsory regardless of whether any renovation is planned: the report and its processing start from €600. We cover it in detail in the façades and ITE guide.

Renovating without living in Spain. The paperwork can be filed by your representative or gestor without you needing to be present; we coordinate it as part of the project, with the same photo-report follow-up we use for the rest of the works.

How do I know if my job needs a declaración responsable or a full building licence?

The general rule: if the works don't touch structure or add built volume or floor area, a declaración responsable is enough. If they add volume — an extension, enclosing a porch into the home, a new build — or affect a building's façade, a full building licence with a technical project is needed. Can I start the works before the building licence is granted?

What happens if I do the works without filing anything?
